The Golden Visa and buying property

Buying an apartment in Dubai and obtaining a right of residence are two separate decisions. Don't reserve a property on the strength of a visa promise alone. First confirm that the unit you have chosen, the way you finance it and your own documents meet the requirements of the relevant procedure.

The Dubai Land Department service for real estate investors concerns property with a purchase value of at least 2 million AED and an application for a renewable 10-year residence. Passing the threshold does not mean the visa is issued or renewed automatically.

Ready property, mortgage and off-plan

With a mortgage, the DLD requires a bank document. The service description refers to confirmation of the amount paid of at least 2 million AED, while the conditions section lists the bank's approval, the amount paid and the balance. These wordings are not fully consistent with each other. Before you buy, confirm with the DLD and your bank which amount has to be shown for your financing.

Don't treat a payment of 20% of the price of an off-plan project as a universal Golden Visa guarantee. Whether the off-plan route is available has to be confirmed for the specific project and your documents. Ask which authority reviews the application and which document stands in for the title deed at that stage.

When you compare new investments in Dubai with ready apartments, also look at the payment schedule, the costs and whether you can use the unit. The property should still suit your needs if the residence procedure takes longer or the application is not accepted.

Documents before you apply

The DLD lists a passport, the title deed and a photo, plus residence documents if you already have them. The conditions require the applicant to be present in the UAE. A family, a mortgage and other circumstances require additional documents.

  • Establish the right route and ask for the list of documents for your own situation.
  • Compare the details of the owner, the property and the financing across the documents.
  • Confirm any required translations and authentication of documents before you order the services.
  • Keep official fees separate from the fee of any intermediary.
  • Keep proof of payments and the application number.

Cost of the procedure and family

The DLD page lists a total fee of 9,884.75 AED for the main applicant. It is separate from the property price, and procedures for family members are priced separately. Check the current fee list before you submit the application.

Plan separately for insurance, documents, travel and administrative services if you need them. Don't add an undefined “visa” amount to the budget: ask who receives each fee and on what basis. Prepare the budget for buying and owning the property independently of the residency budget.

Whether a spouse, children or parents can be included has to be checked against the conditions and documents that apply to each person. Don't assume that one fee and one set of documents covers the whole family.

The Golden Visa and tax residency

A right of residence is not an automatic change of tax residency. Each country applies its own tests, and a visa does not decide the outcome on its own. Whatever your nationality, check the rules of your home country before you move or invest.

Poland-specific: for Polish tax purposes, the relevant tests include, among others, the centre of vital interests or a stay of more than 183 days in a tax year. If two states treat you as a resident, the applicable tax treaty has to be taken into account. These are Polish rules; investors with tax ties to other countries need to check those countries separately.

Before a move or an investment, discuss your situation with a tax adviser. Don't base a decision on a slogan about zero tax alone.

What to establish before you reserve

Prepare three separate summaries: the terms of the purchase, the residence requirements and the tax consequences. If someone promises an automatic visa, ask for the basis and for confirmation from the competent authority for the property you have chosen. Only then compare the whole picture with other properties in Dubai.
